Welcome to the MOBAR (the "app") owned by Anitya Technologies Pte Ltd. MOBAR provides services to you subject to the notices, terms, and conditions set forth in this agreement (the "Agreement"). In addition, when you use any of our services, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they are incorporated into this Agreement by this reference. We reserve the right to change these terms and conditions at any time. ACCESSING, BROWSING OR OTHERWISE USING THE APP INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT, SO PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.
1. Legal capacity to Transact
Persons who are not up to the age of 18 must not use the app. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If MOBAR suffers any damage or other losses as a result of a transaction entered into by a minor, MOBAR reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with MOBAR. you must be up to the age of 18 years before you can use this app to make a purchase in order to be served liquor at the designated bar.
2. Our Services
‘MOBAR’ is an online platform and an app that acts as intermediary between vendors (bars) and their customers. The App sells redeemable vouchers to its users. These vouchers can be exchanged (redeemed) with specified amount of liquor in the premises of vendor.
You understand that MOBAR shall not be liable for any loss or claim, in the event bar refuses to serve user or rejects user’s order. MOBAR shall not be responsible for any deficiency in services of any bar as well as any other act or omission or crime of the bar. We do not provide services to users/customers below the legal drinking age (18 years).
3. Age requirement for users of mobile app
MOBAR app is intended for use only by individuals of legal age (18 years) to consume alcoholic beverages and liquor in Singapore. Individuals who have not reached legal age to consume alcoholic beverages or liquor consumption are prohibited from using the MOBAR mobile/web app.
4. Accessing the Mobile App
Access to the mobile App is permitted on a temporary basis. MOBAR updates the app regularly and so may change the content at any time without notice to you. MOBAR reserve the right to withdraw, vary or suspend the service at any time without notice. You are responsible for making all arrangements necessary to access the app. You are also responsible for ensuring that all persons accessing the app through your internet connection are aware of these Terms and Conditions. MOBAR is a commercial app that can be accessed by anyone but because the majority of the app’s content is alcohol related it is intended for people who are of the legal drinking age (18) and above. Please note that our Mobile App may not be compatible with all devices or operating systems and we shall not be liable for any failure arising in the app which arises from incompatibility (including, without limitation, minimum storage and memory requirements from time to time).
You also agree that you will not:
i. interfere with, or disrupt, the app or any servers or networks connected to the app, including by transmitting any worms, viruses, malware, spyware or any other code of a destructive, malicious or disruptive nature;
ii. inject content or code or otherwise alter or interfere with the way any page of the app is rendered or displayed in a user’s browser or device;
iii. access the app via a means not authorised in writing in advance by us, including but not limited to, automated devices, scripts, bots, spiders, crawlers or scrapers (except for standard search engine technologies);
iv. penetrate or attempt to penetrate the app security measures.
v. by any means copy, reproduce, republish, adapt, upload, link, post, frame, translate, transmit or distribute any part of the mobile app or any Content contained on the app;
vi. do anything that imposes an unreasonable or disproportionately large load on the app, or interferes or disrupts the mobile app or any network or website connected to the app;
vii. breach the security of the app, test or scan the vulnerability of the app, or make any unauthorised modifications to the Website;
viii. interfere with any other persons use or enjoyment of the app;
ix. post, or transmit to the app any abusive, obscene, defamatory, or otherwise inappropriate material;
x. use the app or any Content in any way that is unlawful, illegal or breaches the rights of MOBAR or any third party; and use the app in any way that otherwise breaches these Terms.
If you do any of the acts above, you may be committing a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.
5. Reliance on information posted
Information is provided on the app by way of guidance only. MOBAR therefore disclaim all liability and responsibility arising from any reliance placed on such information to the fullest extent permissible by local law.
6. Ownership
The App and all Content is operated and owned by Anitya Technologies Pte Ltd with the principal place of business in Singapore.
7. Password Security
Password security is the sole responsibility of the MOBAR visitor and customer. MOBAR accept no responsibility for access gained by others to your personal information, including but not restricted to information pertaining to your identity or credit card, through the owner of these details not exercising reasonable caution and security against theft or misuse. It is the responsibility of visitors and customers to the app to ensure the privacy of their own password. MOBAR encourage our members to change their passwords on a regular basis, and to use alphanumeric combinations. While registering with MOBAR, Users must provide accurate and correct information about themselves.
8. Modification of these terms of use
MOBAR reserves the right to change the terms, conditions, and notices under which the MOBAR app is offered, including but not limited to the charges associated with the use of the MOBAR mobile app.
9. Links to third party sites
This app may contain links to other websites ("linked sites"). The linked sites are not under the control of MOBAR and MOBAR is not responsible for the contents of any linked site, including without limitation any link contained in a linked site, or any changes or updates to a linked site. MOBAR is not responsible for any other form of transmission received from any linked site. MOBAR is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by MOBAR of the site or any association with its operators.
10. Product Reviews, comments and Feedback
MOBAR app allows users to leave personal Comments and ratings about the bar and products. While doing so, you warrant that:
• your comments will reflect your genuinely held opinion of the product;
• your comments will not be obscene, abusive, illegal, criminal, threatening, defamatory, objectionable, invasive of privacy, injurious to third parties or be misleading as to the origin of the content;
• your comments will not infringe the intellectual property rights of a third party;
• you will not use a false email address or impersonate any person or entity; and
• you acknowledge that we may remove or edit your comments.
If you provide comment on a product, you grant us the right to use and display your comments for any purpose in relation to the product throughout the world.
11. Intellectual Property
All content contained within the MOBAR Mobile app, it’s marketing collaterals both online and offline, graphics, button icons, images, audio clips, digital downloads, data compilations, and logos are subject to copyright owned by MOBAR and its suppliers/licensors and are protected by the laws of Singapore governing copyright and intellectual property ownership. Copyright of content provided under license to MOBAR by third parties, is owned by that third party and may not be reproduced without permission from said third party. It is not permissible to reproduce any content from MOBAR for commercial, educational or private use without express permission in writing from MOBAR. Any improper use as defined under copyright law is strictly prohibited and will be prosecuted. The compilation of all content on this app is the exclusive property of MOBAR with copyright authorship for this collection by MOBAR and protected by international copyright laws. You are granted only limited access for the purpose of viewing the material contained on this mobile app. You are not permitted to publish, manipulate or distribute in any format, any of the copies of the content supplied to you or which appears on this app or use such content in connection with any business or commercial enterprise.
12. Services countries
The Mobile app is provided for users in the Singapore only. Whilst access may be possible from outside the Singapore, the Website and App are not intended for such use and such users access the Website or App at their own risk. You are responsible for compliance with applicable local laws relating to the use of or otherwise connected with the App. To the extent that the App or any activity contemplated by it would infringe any law of a jurisdiction other than Singapore, then you are prohibited from accessing or using the App or attempting to carry on any such offending activity and this provision shall override all other provisions of these Terms and Conditions.
13. Trademarks and copyright
All trademarks on this App belongs to each trademarks owners so therefore except the contrary is expressly stated, all persons [ inclusive of their names and images], third party trademarks and contents or locations featured on this website are in no way associated or affiliated to MOBAR and should rely on the existence of such connection or affiliation. Where a brand name is referred to, it is only used to describe the products and services and it is in no way an assertion that such products or services are endorsed by or connected to MOBAR.
14. Warranties
MOBAR makes no representations or warranties of any kind pertaining to this App or the information and materials contained in it. MOBAR shall not be responsible for any damage, loss or injury suffered by attack, viruses or any technologically dangerous, harmful materials that can destroy your data, computer system, service, computer program or any material by using this website, downloading from the website or any linked app to it.
15. Indemnification
Users hereby indemnify and hold harmless MOBAR from any error, omission and information leaked out through its servers. You agree not to sue MOBAR for any Injury suffered for any information leaked through this platform, as such error or leaked information isn’t intentional. MOBAR will provide the details and information of restaurants on the app, such as menu and pictures, please take note that MOBAR do not have any responsibility for the accuracy and completeness of the information provided.
16. Severability
If any of these provisions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed several and shall not affect the validity and enforceability of any remaining provision.
17. Disclaimer
Your use of the services and products provided by bar is at your sole risk. The products are offered on an “as is” and “as available” basis company expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the services and products offered by bar, or any reliance upon the services of bar without limiting the generality of the foregoing, company makes no warranty that the services provided by bar will be good and fit for purpose.
